Terms of Use

1. Acceptance of these Terms

These Terms of Use ("Terms") form a binding agreement between you and Nguyen Tien Duoc ("we", "us") regarding your use of the SpeakIt application and this website (together, the "Service"). By accessing or using the Service, you confirm that you can form a binding contract and that you agree to these Terms and to our Privacy Policy.

2. License to use SpeakIt

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use SpeakIt on Apple devices that you own or control, in accordance with the Apple Licensed Application End User License Agreement and these Terms. The App is licensed, not sold, to you.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• use the Service to process or distribute content that infringes the intellectual property, privacy, or other rights of others;
• reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by law;
• interfere with or disrupt the Service or the servers and networks used to provide it; or
• use the Service to create a competing product or to misrepresent your relationship with us.

4. Your content

"Your Content" means any text, documents, images, links, or audio you provide to or generate with SpeakIt. You retain all rights to Your Content. Because SpeakIt processes Your Content on your device, we do not claim ownership of it and do not upload it to our servers to read it aloud. You are solely responsible for Your Content and for ensuring you have the legal right to use, import, scan, read aloud, export, or share it. You agree not to use SpeakIt to reproduce, distribute, or publicly perform copyrighted material without authorization. SpeakIt is intended for personal use of text that you own or have permission to use.

5. Purchases & SpeakIt Pro

SpeakIt is free to download. It offers an optional one-time in-app purchase, "SpeakIt Pro," which unlocks additional features such as unlimited folders. SpeakIt Pro is a one-time purchase, not a subscription, and does not auto-renew.

All purchases are processed by Apple through the App Store and are subject to Apple's terms. Payment will be charged to your Apple Account at confirmation of purchase. You can restore a previous purchase on a new device using the "Restore Purchases" option. Refunds are handled by Apple in accordance with the App Store terms; we are generally unable to issue refunds directly.

6. Third-party services

The Service uses platform features provided by Apple and Google Firebase, and may let you open third-party content such as web pages. Your use of those services and any third-party content is subject to their respective terms and privacy policies. We are not responsible for third-party services or websites.

7. Intellectual property

The SpeakIt app, its name, logo, design, and all related materials are owned by us and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you. Any other product or company names referenced may be trademarks of their respective owners.

8. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that speech output, text recognition, or AI-generated text will be accurate or suitable for any particular purpose. Output quality depends on your device, the selected voice, the language, and the formatting of the source text. If you rely on SpeakIt for accessibility or other important purposes, please test the output before depending on it. You use the Service at your own discretion and risk.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the extent liability cannot be excluded, our total liability for any claim relating to the Service is limited to the amount you paid for the App, if any, in the twelve months before the claim.

10. Termination

These Terms apply for as long as you use the Service. You may stop using SpeakIt at any time by deleting the App. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitations of liability) will continue to apply.

11. Changes to the Service or Terms

We may update, change, or discontinue features of the Service, and we may revise these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
